Appeals court hears arguments on forest roads rule

•  Court News     updated  2010/03/11 08:35

Lawyers for the state of Wyoming and the Colorado Mining Association say a 2001 federal rule banning construction of new roads on National Forest land violates the law.

The 10th U.S. Circuit Court of Appeals in Denver heard oral arguments Wednesday in Wyoming's lawsuit challenging the rule.

The U.S. Department of Agriculture — the parent agency of the National Forest Service — and environmental groups argue the rule is legal.

The two sides also made arguments on whether the rule-making process followed federal laws.

The rule affects at least 40 million acres of federal land nationwide.

The court did not indicate when it would decide the case.

Toyota sued for fatal crash linked to throttle

•  Court News     updated  2010/02/08 09:04

A lawsuit has been filed in Los Angeles against Toyota Motor Corp. asking the automaker to expand its recall for models not equipped with a brake override system.

The lawsuit was filed Thursday on behalf of the family of Noriko Uno. The family's attorney, Garo Mardirossian, says Uno was killed in August in San Bernardino County when her 2006 Camry suddenly accelerated in a residential street despite her attempts to stop.

The attorney says the fatal crash could have been avoided had the vehicle been equipped with a backup brake system.

Toyota has recalled several models because their accelerator pedals could get stuck. The only Camry models included were from 2007-2010.

The lawsuit, which claims product liability and negligence, seeks general and punitive damages.

SC man accused in Halloween shooting due in court

•  Court News     updated  2008/11/03 14:18

A convicted felon accused of gunning down a 12-year-old South Carolina trick-or-treater is expected in court.

Quentin Patrick was arrested after the Friday night shooting. Authorities said he'll have a bond hearing Monday afternoon.

Police say Patrick told them he thought he was being robbed before he blasted at least 29 shots from an assault rifle from inside his home. The family had stopped at the house to collect candy because the porch light was on.

T.J. Darrisaw was killed. His father and 9-year-old brother were wounded.
